These Terms of Service ("Terms") govern your use of The Spelling Test mobile application (the "App") and our website at spellingtest.app (the "Site"), together the "Service", provided by The Spelling Test ("we", "us").

By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (16 in the EEA/UK) to use the Service. Younger users may use the Service with the involvement of a parent or guardian.

All audio files, word lists, designs, and code are owned by us or our licensors. The OpenAI-generated audio is licensed for use within the Service. You may not redistribute or scrape audio files.

6. User-submitted content

Feedback you submit may be reviewed by our team. By submitting feedback, you grant us permission to use it to improve the Service. Do not submit confidential information in feedback.

7. Subscriptions

Spelling Test Plus is offered as an auto-renewing monthly or yearly subscription. Pricing, renewal, and cancellation are governed by our Subscription Terms and by the rules of the platform that processes the payment (Apple App Store or Google Play).

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We make no guarantee that the Service will be uninterrupted or error-free, or that pronunciations are perfectly accurate for every word in every dialect.

9. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from the Service is limited to the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) USD $50.

10. Termination

You may stop using the Service at any time. We may suspend or terminate the Service or your account for material violations of these Terms. Surviving sections (IP, disclaimers, limitation of liability, governing law) remain in effect.

11. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of competent jurisdiction in the United States.

12. Changes

We may update these Terms occasionally. Material changes will be announced inside the App. Continued use after changes constitutes acceptance.
